SUPPLY AGREEMENTS & CONTRACTS
As planning for the 2011 season is well underway on most farms this is a traditional time of year for merchants to agree supply agreements with growers. In general written contracts are not used in the industry with long standing verbal agreements with growers the norm. There are in some cases supplier undertakings issued by merchants in relation to quality assurance systems in place with the merchant.
Growers are urged to seek legal advice before signing any undertaking especially if there are any financial implications associated with the documents being signed. Now is the time to sort out issues like this as opposed to waiting until the crop is grown and possible even sold.
Quality assurance systems are an important part of the industry at all levels however documentation in relation to these systems must be confined to issues relating to the quality assurance system with no references to financial issues.
